Wyno — Terms of Use

1. Who we are

Wyno is operated by Wyno Pte. Ltd. (UEN 202630022M), Singapore, registered office 68 Circular Road, #02-01, Singapore 049422. Contact: support@wyno.ai.

2. Accepting these Terms

These Terms form an agreement between you and Wyno. If you create an account, you accept these Terms by selecting the required acceptance box during registration. If you use Wyno as a guest, you accept these Terms by selecting the required acceptance box before starting the wine quiz. If you do not accept these Terms, you must not create an account, start the guest quiz or use Wyno.

3. What Wyno is

Wyno is a wine recommendation service. Based on preferences you give us and wines you rate, we suggest wines from the list of the venue you are visiting. Wyno is free for you. You do not buy wine through Wyno — you order from the restaurant in the normal way.

4. Eligibility and age

You must be at least 18 years old to use Wyno. This is Wyno's minimum-age requirement for an alcohol-related service. If you create an account, you must provide your date of birth. Wyno will prevent account creation where the date provided indicates that you are under 18. If you use Wyno as a guest, you must confirm that you are at least 18 before starting the wine quiz. You must provide accurate information and must not use Wyno on behalf of a person under 18.

5. Responsible drinking

Wyno helps you discover and enjoy wine. We encourage responsible drinking and do not condone excessive consumption. Decisions about what and how much you drink are your own.

6. Recommendations are suggestions, not advice

Recommendations are generated by an automated algorithm and are suggestions based on taste — not professional, medical, dietary or health advice. We do not guarantee a wine will be available, that the price is correct, or that such wine will suit you. Prices and availability are set by the venue. Before ordering or consuming wine, you should check the bottle, vintage, label, ingredients and allergens with the venue. Wine may contain allergens, including sulphites, that may not be fully reflected in Wyno's data. If you have an allergy, intolerance or medical condition, obtain the relevant information from the venue and do not rely solely on Wyno.

7. Featured wines and commercial placements

Participating venues may select certain wines to receive additional visibility within Wyno. These may include customised restaurant promotions. These are commercial placements made available as part of the venue's paid subscription to Wyno. They will be clearly identified in the app as wines promoted by the venue. Wyno does not receive a commission or revenue share based on the wine you order. A featured wine may be included in the wines considered by Wyno's recommendation system, but featured status does not guarantee that the wine will be recommended to you. Your stated preferences continue to influence the recommendations you receive, and you may always view the venue's full wine list.

8. Loyalty programme

Registered users may earn Loyalty Points by completing qualifying activities identified in the app, including confirming wines they have actually ordered.

Loyalty Points:

  • cannot be purchased;

  • are not money or stored value;

  • have no cash value;

  • cannot be transferred to another person; and

  • may be used only for rewards made available through Wyno.

Rewards are selected, offered and supplied by the participating venue. The venue bears the cost of the reward and is responsible for honouring a valid redemption. Wyno administers the points and redemption mechanism but does not itself supply, fund or guarantee the reward. Wyno determines how Loyalty Points are issued, the number of points assigned to each reward tier and when points expire. Each venue independently decides which reward, if any, it offers at a particular tier and the retail value of that reward.

Unless otherwise stated in the app, Loyalty Points expire after 12 months without qualifying activity or when your account is closed. Wyno may cancel points that it reasonably determines were obtained through false confirmations, fraud, manipulation or other abuse of the programme.

Wyno may amend, suspend or discontinue the loyalty programme for legal, security, technical or legitimate operational reasons. If a change is material and disadvantageous to users, Wyno will give reasonable advance notice unless immediate action is required for legal, security, fraud-prevention or abuse-prevention reasons. Any Reward validly redeemed before a change, suspension or discontinuance takes effect will remain unaffected. Wyno may cancel Loyalty Points that it reasonably determines were obtained through false confirmations, fraud, manipulation or other abuse of the programme.

8A. Marketing and birthday offers

If you opt in, we may use your date of birth to send you an occasional birthday offer, and send you other promotional messages. You can opt out at any time in Settings, without affecting your use of Wyno.

9. Your content

You retain ownership of the ratings, notes and other content you submit to Wyno. You grant Wyno a non-exclusive, worldwide and royalty-free licence to host, store, reproduce, process and use that content only as reasonably necessary to operate, secure, maintain and improve Wyno and to produce aggregated or anonymised insights. This licence continues for as long as the relevant content is retained in accordance with the Privacy Notice. Wyno will not publish content under your name or identify it as yours without your permission..

10. Our content

The Wyno platform, brand, software and recommendation algorithm are ours. Wine data may come from third parties. You may not copy, scrape or redistribute it.

11. Availability and changes to the service

Wyno will provide the service with reasonable care and skill. However, Wyno does not guarantee that the service will always be uninterrupted, error-free or available on every device. Wyno may maintain, update or change the service for legal, security, technical or legitimate operational reasons. Clause 15 explains how material changes will be communicated. Nothing in these Terms affects any rights or remedies that you have under mandatory consumer law if Wyno fails to supply the service as legally required.

12. Our responsibility

Nothing in these Terms excludes or limits Wyno's liability for:

  • death or personal injury caused by Wyno's negligence;

  • fraud or fraudulent misrepresentation;

  • wilful misconduct where liability cannot lawfully be limited;

  • breach of any mandatory consumer right; or

  • any other liability that cannot lawfully be excluded or limited.

Wyno does not sell or serve wine and is not a party to the transaction between you and the venue. The venue is responsible for the sale and service of wine, its prices and availability, information concerning ingredients and allergens, and the rewards it offers.

To the fullest extent permitted by applicable law, Wyno is not responsible for:

  • losses that were not reasonably foreseeable when you accepted these Terms;

  • losses resulting from inaccurate information supplied by a venue or another third party;

  • losses caused by your breach of these Terms or misuse of Wyno; or

  • business or professional losses arising from use of a service intended for personal consumers.

These exclusions do not apply where the loss was caused by Wyno's failure to exercise reasonable care and skill or by Wyno's breach of a liability that cannot lawfully be excluded.

Nothing in these Terms excludes or restricts any right or remedy available to you under the Consumer Protection (Fair Trading) Act 2003 or any other applicable law.

13. Ending or suspending your use

You may stop using Wyno and delete your account at any time through Settings → Privacy → Delete account or by contacting support@wyno.ai. When your account is deleted, Wyno will delete, de-identify or retain your personal data in accordance with the Privacy Notice and applicable law. Account deletion does not necessarily require the immediate deletion of information that Wyno must retain for legal, security, fraud-prevention or accounting purposes.

Wyno may suspend or terminate your access where it reasonably believes that:

  • you have materially or repeatedly breached these Terms;

  • you have obtained Loyalty Points through false confirmations, fraud or abuse;

  • your account creates a security risk; or

  • suspension or termination is required by law.

Where reasonably practicable, Wyno will tell you the reason and give you an opportunity to correct the issue before termination. Wyno may act immediately where necessary for security, fraud prevention or legal compliance.

13A. App stores

Once distributed via the Apple App Store or Google Play, you acknowledge that Apple Inc. and Google LLC are third-party beneficiaries of these terms and may enforce them, and your use must comply with the relevant store's terms.

15. Changes to these Terms

Wyno may update these Terms to reflect changes to the service, applicable law, security requirements or legitimate operational needs. If a change materially affects your rights or use of Wyno, Wyno will give reasonable advance notice through the app or by email. Changes apply from the effective date stated in the updated Terms and will not apply retroactively. Where required by applicable law, Wyno will ask you to accept the updated Terms before you continue using the service. If you do not agree to a material change, you may stop using Wyno and delete your account..

16. Governing law and disputes

These Terms are governed by the laws of Singapore. If you are a consumer habitually resident in Italy or another EU Member State and Wyno directs its services to that country, this choice of law does not deprive you of any mandatory consumer protection available under the law of your habitual residence.

If a dispute arises, you and Wyno should first attempt in good faith to resolve it by contacting support@wyno.ai. Either party may request a written response, and the parties should allow 30 days for an amicable resolution unless the matter is urgent.

If the dispute is not resolved, you and Wyno may agree to refer it to mediation administered by the Singapore International Mediation Centre in accordance with its Mediation Rules. Mediation may take place remotely or in Singapore, as agreed. Participation in mediation is voluntary for consumers unless applicable mandatory law permits otherwise.

Nothing in this Section prevents either party from seeking urgent or interim relief or restricts any right that a consumer has under mandatory law to commence proceedings before a competent court.

Subject to those mandatory consumer rights, the courts of Singapore shall have jurisdiction over disputes arising out of or in connection with these Terms.
